The Non-Compete Clause Rule

The Federal Trade Commission (“FTC”) has issued the Non-Compete Clause Rule (“Rule”) banning all new non-compete clauses in employment agreements and invalidating most existing ones. The stated purpose of the Rule is to protect workers' fundamental freedom to change jobs, increase innovation, and foster new business formation. Unless defeated by legal challenge, the Rule will be effective September 4, 2024.
